What qualification does an agent need to sell my home?

An agent must hold a Certificate of Registration issued by NSW Fair Trading. Regular training must be undertaken to remain registered.

What does material fact refer to?

Factors that may not be immediately visible to a buyer are classified as material fact. This can vary from noisy neighbours to a previous incident at the property and it is the owners’ obligation to disclose this to potential Purchasers.

What is a vendors bid?

This is a bid made on behalf of the owner not a buyer. This bid may only be made by the auctioneer and it must be disclosed as a vendors bid.

What is a “Contract For Sale Of Land” and who prepares this?

Prior to your property been marketed for sale the agent will need to have received the Contract For Sale. This can be issued by a conveyancer or solicitor and will contain important documents such as the title search, council zoning certificate and sewer diagram.

What contract do I have withour chosen agent?

In order for all details of the sale to remain transparent a contract known as an “Exclusive Agency Agreement” is completed between the agent and the owner. The owner is known as the “Principal” in the agreement.

Can I sell prior to the auction date?

Yes, it’s entirely your choice. We advertise our properties as “Auction if not sold prior”. Should you decide to accept an offer prior to auction then the exchange will be unconditional.

Can I sell my property while it is leased?

Yes. However if your property is leased and the tenant is in a fixed term lease then the property will be sold as “Subject To Existing Tenancies” and the tenant has the right to continue with their lease. On a periodic lease the tenant can be given 30 days notice to vacate on exchange of contracts.

If selling by auction when do I set my reserve?

Your agent will meet with you a few days prior to the auction date to set the reserve. Based on buyer feedback, prior offers and your own choices, your agent will be able to advise you accordingly and assist you in setting a reserve.
